Tennessee Foreclosure Law Summary


Most Common Method of Foreclosure: Power of Sale.

Preforedosure Notice:
Number of Notices: One: Notice of Sale.

Amount of Notice Required: Notice to be sent to debtor by registered mail, return receipt requested, 30 days prior to publication date. If by publication, twenty days. If by posting, thirty days. Must publish three times with the first notice at least twenty days prior to the sale.

Content of Notice: a) Names of parties; b) description of the land; cf time and place of sale; and d) identification of any federal or state liens.

Method of Service: By publication or by posting.

Redemption: Up to two years.

Deficiency: A deficiency judgment is obtainable.

Miscellaneous: The sale is not voidable nor void if the notice provisions are not complied with. The trustee could be guilty of misdemeanor, however.
