Connecticut Foreclosure Law Summary
Most Common Method of Foreclosure: Strict foreclosure {no sale). If the strict foreclosure process is used, the court gives the mortgagor a period of time to pay the debt; if the mortgagor does not do so within the specified period of time, title vests in mortgagee. The court may also order foreclosure by sale.
Judicial Foreclosure Procedure: Strict foreclosure is commenced by filing of Writ, Summons, and Complaint, as in any other civil action. Must serve all junior lienholders. Lender must provide Notice to homeowner of statutory protections from foreclosure at time the action commences.
Redemption: If the court orders foreclosure by sale, the redemption period is set by the court. An encumbrancer can redeem.
Deficiency: A deficiency judgment is obtainable within thirty days after the redemption period expires, and after a court hearing.
Miscellaneous: The mortgagor, if underemployed or unemployed, can apply for protection from foreclosure and the court can restructure the debt. But the mortgagor cannot raise a defense to foreclosure and file for protection. ("Emergency Mortgage Assistance Program").
